Fitness for Human Habitation Act extension

On 20th March 2020 the Homes Fitness for Human Habitation Act extension will come in to play to apply to existing tenancies in England.

The law, which was introduced in 2019, was brought in to ensure that rented homes are safe and secure.  It gives tenants the power to take their landlord to court if this is not the case. For tenants who signed their contracts after 20th March 2019 they were able to use the act immediately.  From 20th March 2020, all tenants will be covered by the act.

What does Fitness for Human Habitation mean?

Fitness for human habitation means that there is a defect in the property that is so serious that a court considers the property to be unfit for that person to live in.  Therefore, a younger, fitter tenant living on their own would have a higher threshold for what is unfit for them to live in than an older person or someone with a young family.

The key question when determining unfitness for human habitation is whether a property is ‘not reasonably suitable for occupation in that condition’ because of one or more of the following factors:

  • repairs
  • freedom from damp
  • internal arrangement
  • natural lighting
  • ventilation
  • water supply
  • drainage and sanitary conditions
  • stability
  • facilities for preparation and cooking of food and for the disposal of waste water
  • any ‘prescribed hazard’ – this is defined as any matter or circumstance amounting to a category 1 or 2 hazard under the Housing Health and Safety Rating System (HHSRS).
